Octrooien en
Kunst zijn de bronnen van inspiratie om deze werken te maken. Begin 1991
ontdekte Jowi Burger, toen werkzaam als octrooigemachtigde bij Shell, de
vreugde van het tekenen en schilderen van abstracte werken en portretten.
Sindsdien beoefent hij de beeldende kunst, terwijl hij zich ook bezig houdt met
het recht op de intellectuele eigendom als legal counsel. Sinds zijn
pensionering bij Shell eind 2007 is hij zzp’er en is hij voornamelijk actief op
het gebied van de octrooiprocesvoering (http://jowi-ips.blogspot.nl/ ).
Toch vormen
technologische uitvindingen en hun bescherming middels octrooien een gebied van
doorgaande interesse voor hem. De omvang van octrooibescherming, die wordt
gezocht in een octrooiaanvrage wordt bepaald door zogenaamde octrooiconclusies.
Om adequate octrooibescherming voor een uitvinding te verkrijgen, zal de
octrooigemachtigde een hoofdconclusie (conclusie 1) opstellen, die zoveel
denkbare voorkeursuitvoeringen van de uitvinding als mogelijk omvat. Deze
voorkeursuitvoeringen, waarvoor afzonderlijke zogenaamde onderconclusies worden
opgenomen in de octrooiaanvrage, worden in het Engels ‘preferred embodiments’ genoemd.
De link
tussen zulke onderconclusies en JowiArt Preferred Embodiments is de selectie uit een brede omvang. In het
geval van een octrooieerbare uitvinding, wordt deze brede omvang bepaald door
de hoofdconclusie en in het geval van een ‘Art Invention’ door het totale originele
kunstwerk (vergelijkbaar met de hoofdconclusie). Geselecteerde details of
uitsneden (‘JowiArt Preferred Embodiments’) van dat originele werk worden
vergroot en ten behoeve van de vergelijking met octrooiconclusies geïdentificeerd
door een Romeins cijfer (nummer van de Art Invention) gevolgd door het woord ‘Claim’
en het nummer van het geselecteerde detail.

Patents and
Art are the sources of inspiration to
create these works. Early 1991 Jowi Burger, at that time patent attorney at
Shell discovered the joy of drawing and painting abstract works and portraits.
Ever since he practises art while being also occupied with intellectual
property law as a legal counsel. Since his retirement with Shell by the end of
2007 he is self-employed (http://jowi-ips.blogspot.nl/
) and mainly active in the field of patent litigation.
Still
technological inventions and their protection by patents represent an area of ongoing interest to him. The scope of patent protection sought in a patent
application is defined by so-called patent claims. In order to provide adequate protection of an invention
the patent attorney will draft a main
claim (claim 1) which covers as many thinkable preferred examples of the
invention as possible. These examples for which separate so-called sub-claims
are incorporated in the patent application are also referred to as ‘preferred
embodiments’.
The link
between such patent sub-claims and JowiArt Preferred Embodiments is the selection from a broad scope. In case of
a patentable invention, this broad scope is defined by the main claim and in
case of the ‘Art Invention’ this broad scope is provided by the total original work
(comparable with the main patent claim). Selected details or cut-outs (‘JowiArt
Preferred Embodiments’) of that original work are enlarged and for sake of
comparison with patent claims identified by a roman numeral (number of the Art
Invention) followed by the word ‘Claim’ and the number of the selected detail.
